Do You Need a Business Litigation Attorney? Find One with These 7 Tips

No one wants to ever need a business lawyer. It is rarely a good sign when litigation attorneys need to be brought in for a situation. Unfortunately, there are times when you need their services. You will need to find the right lawyer for your situation.

  1. Ask your friends, family and colleagues. Given the litigious nature of the society we live in, the chances are good that you know at least one person who has enlisted the help provided by business litigation attorneys. The best way to find quality products and services is to get a personal referral. You may not go with the same law firm that your friend, family member or business associate used, they may have needed a securities fraud attorney when you need something else but this can give you a good place to start your search.
  2. Talk to other lawyers you know. If you have ever needed the services of any kind of attorney, you should ask that person for advice about business litigation attorneys, they probably cannot help with your issues but they may be able to give you a list of lawyers to check out. Remember that, like doctors, lawyers specialize. The great personal injury layers who worked on your cousin’s lawsuit cannot help with probate litigation, for example. They cannot say yes if you do not ask and it is always worth asking.
  3. Ask the business litigation attorneys about their experience. When you are interviewing different litigation attorneys, you should always ask how much experience they have working on your kind of case. Ask, too, about how much of their practice is devoted to it. It matters little if they have been working on your kind of case for 20 years if they only handle one similar case a year. You need to find a lawyer who is good at both negotiating and who has experience in the courtroom.
  4. How much do they listen? When you are talking to the various business litigation attorneys, how much do you think they are actually listening to you? You need to be confident that your lawyer is listening to what you are telling them and is interested in your case. If they will not take the time to answer your questions before you hire them, you can bet they will not find the time afterwards.
  5. What do they think of the merits of your case? You need a good litigation lawyer, not a person who is just going to tell you what you want to hear. You need to go through the strengths and weaknesses that they see in your case. This is very important. If they are not going to look at your case objectively, they will fail in negotiations and in court. You need to have a realistic idea of what you are facing with your case and you need someone on your side who will be totally and brutally honest with you. Anything less is a waste of money and time.
  6. Go over pricing. When you are talking to different business litigation attorneys, you need to know how much the whole thing will end up costing. You may find that it is better to settle at some point than fight to the bitter end. You also need to be completely clear about the law firms billing policies and what costs you will be responsible for. Law firms have a lot of leeway and can charge their clients pretty much any way they want. Do not hire anyone until you know what you are getting into financially.
  7. Who will handle your case? For the most part, law firms rely on legal assistants and paralegals to do a lot of the work. That is normal but you should get to meet the people who will be working on their case. Ask who will be around to answer your questions when you have them. You may not always be able to talk to the main attorney who is handling your case but they should be available at least some of the time.

Finding the right business attorney for your needs will take work but it will be worth it.
